Estate Planning for a Beneficiary with a Substance Abuse or Mental Health Disorder

Meyer, Unkovic & Scott’s Martin J. Hagan will be a featured presenter at the Pennsylvania Bar Institute’s (PBI) Elder Law Institute scheduled for July 20th at the Harrisburg, Pa. Hilton & Towers. He will co-present on the topic of: Estate Planning for a Beneficiary with a Substance Abuse or Mental Health Disorder

Today an increasing number of parents and grandparents find themselves needing legal advice on how best to address in their estate plans the reality that one or more of their children or grandchildren, typically a young adult under age 40, is addicted to opioids or alcohol, or has been diagnosed with a serious mental disorder.

Mr. Hagan’s presentation will focus on the Special Needs Trust as the preferred solution for such beneficiaries, including a description of the unique nature of such a Trust; linking trust distributions with the beneficiary meeting certain benchmarks relating to treatment and recovery; preserving the beneficiary’s eligibility for SSI and Medicaid; selecting the appropriate trustees; and the important role of the trust protector.
